1. Who We Are and Acceptance
TagTreat is the brand and service provider identified in these Terms. References to “TagTreat,” “we,” “us,” or “our” mean the operator of the TagTreat platform.
By creating an account, purchasing a subscription, or accessing or using TagTreat, you agree to these Terms, our Privacy Policy, and our Refund Policy. If you use TagTreat for a company or other organization, you represent that you have authority to accept these Terms on its behalf.
If you do not agree, do not create an account, purchase a subscription, or use the service.
2. Eligibility and Business Accounts
You must be legally able to enter into a binding agreement and be at least 18 years old to create or administer a business account. You agree to provide accurate, complete, and current information and to keep it updated.
You are responsible for protecting your account credentials, controlling access by staff or contractors, and all activity performed through your account. Notify us promptly at support@tagtreat.com if you suspect unauthorized access.
3. The TagTreat Service
TagTreat is a software platform that helps local businesses encourage and manage customer social sharing through QR-code campaigns and rewards. Depending on the selected plan and available features, the service may let businesses:
- Create and manage social-sharing campaigns
- Generate or display campaign QR codes and customer instructions
- Receive and verify customer-submitted social post links
- Configure and track reward eligibility and redemption
- Review campaign activity, usage, and related analytics
Current plan features, usage limits, prices, and billing intervals are shown in the product interface or checkout before purchase. TagTreat may improve, add, modify, or retire features as the service evolves.
4. Campaigns, Rewards, and Customer Participation
Businesses create and control their campaigns, including reward descriptions, availability, eligibility, timing, and redemption rules. Businesses must present accurate terms, comply with applicable advertising, consumer protection, promotion, and disclosure laws, and honor the rewards they offer.
TagTreat provides campaign technology but does not provide, sell, or fulfill a participating business’s in-store reward. Reward quality, availability, and fulfillment are the responsibility of the business offering the reward.
Customer participation is voluntary. TagTreat does not require a customer to express a positive opinion or misrepresent an experience. Customers remain responsible for their social accounts, published content, disclosures, and compliance with the rules of Instagram, TikTok, or other third-party platforms.
5. Customer Content and Intellectual Property
Customers retain ownership of the social content they create. Submission of a post link for campaign verification does not, by itself, transfer ownership or grant a business permission to reuse that content outside the campaign process. Businesses must obtain any permissions required to repost or otherwise use customer content.
TagTreat and its licensors own the service, including its software, design, branding, documentation, and other materials. Subject to these Terms, we grant account holders a limited, non-exclusive, non-transferable, revocable right to use the service for their internal business purposes during an active account or subscription.
You may not copy, sell, sublicense, reverse engineer, interfere with, or create derivative works from the service except where applicable law expressly permits it.
6. Acceptable Use
You may not use TagTreat to:
- Engage in unlawful, fraudulent, deceptive, abusive, or harmful activity
- Create false, misleading, or unavailable offers or reward terms
- Require dishonest endorsements or suppress genuine customer opinions
- Infringe intellectual property, privacy, publicity, or other rights
- Gain unauthorized access to accounts, systems, or data
- Disrupt, overload, probe, scrape, bypass, or manipulate the service or its verification systems
- Introduce malicious code or use the service to distribute spam
We may investigate suspected misuse and suspend or restrict access where reasonably necessary to protect users, third parties, or the service.
7. Plans, Prices, and Billing
TagTreat may offer free and paid subscription plans. Before a paid order is placed, the checkout will identify the plan, included usage allowance or key features, price, currency, applicable billing period, and any taxes or adjustments.
Unless the checkout states otherwise, paid subscriptions are billed in advance and renew automatically for successive monthly billing periods until canceled. You authorize recurring charges for the selected plan. We will provide notice of material price changes when required by law.
Paid orders are processed by Paddle.com and its applicable affiliates (“Paddle”), our authorized reseller and Merchant of Record. Paddle manages payment processing, applicable sales taxes, receipts, payment-related buyer support, returns, and approved refunds. Paddle’s Buyer Terms and Privacy Notice also apply to transactions processed by Paddle.
8. Plan Changes, Cancellation, and Refunds
You may cancel a paid subscription at any time using the subscription-management link in your Paddle receipt or confirmation email, through Paddle’s buyer portal, or by contacting support. Unless otherwise stated or required by law, cancellation takes effect at the end of the current paid billing period, access continues until then, and no further renewal charge will be made.
Upgrades may take effect immediately and may include an account credit displayed before confirmation. Downgrades normally take effect at the end of the current billing period. The effective date, charge, credit, and next renewal price are shown before you confirm a plan change.
Refund eligibility and the request process are described in our Refund Policy. Because Paddle is the Merchant of Record, approved refunds are issued by Paddle rather than paid directly by TagTreat.
9. Third-Party Services
TagTreat may rely on or link to third-party services, including social networks, analytics providers, email providers, infrastructure providers, and Paddle. Their services are governed by their own terms and privacy practices.
We do not control third-party availability, policies, content, or technical changes. Changes made by a third party may affect TagTreat features, including social-post verification or payment functionality.
10. Service Availability and Changes
We work to provide a reliable service, but do not guarantee uninterrupted, secure, or error-free operation. Maintenance, updates, security events, internet failures, third-party changes, or circumstances outside our reasonable control may affect availability.
We may modify, suspend, or discontinue all or part of the service. Where a change materially affects a paid subscription, we will provide notice when reasonably practicable or legally required.
11. Suspension and Termination
You may stop using TagTreat at any time. We may suspend or terminate access if you materially breach these Terms, fail to pay applicable charges, create legal or security risk, or use the service in a way that may harm TagTreat, users, or third parties.
Termination does not affect obligations or rights that arose before termination. Provisions that by their nature should survive—including ownership, payment obligations, disclaimers, liability limitations, and dispute-related provisions—will continue to apply.
12. Disclaimers
To the extent permitted by law, TagTreat is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.
We do not guarantee campaign participation, social-media reach, customer acquisition, revenue, reward redemption, or any particular business result.
Nothing in these Terms limits warranties or rights that cannot lawfully be excluded.
13. Limitation of Liability
To the fullest extent permitted by law, TagTreat will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from or related to the service.
These limitations do not apply to liability that cannot lawfully be limited or excluded.
14. Changes to These Terms
We may update these Terms to reflect changes to the service, business practices, or legal requirements. We will revise the “Last updated” date and provide additional notice where required. Continued use after revised Terms take effect constitutes acceptance of the updated Terms.
